Please read these terms carefully before using any Yoho.Cloud services.
Welcome to Yoho Cloud! This Agreement documents the understanding between Prabhu Soft Pvt Ltd. (referred hereinafter as "Yoho.cloud", "our", "we", and "us") and the Customer (hereinafter referred to as "Customer" and "you").
Customer concurs to be billed in advance, starting upon Yoho.cloud's receipt by email, fax, or mail. Contract takes effect at the date of receipt of payment.
This agreement can be automatically renewed every month or quarter (depending on the hosting plan selected) unless cancelled in writing by the Customer prior to the renewal date. Cancellations must be submitted in writing by email, fax, or mail.
In the event that Customer fails to pay in advance, Yoho.cloud reserves the right to suspend Customer's account and services immediately with or without prior notice. Failure to pay includes expired, declined, and inactive credit cards, in addition to invalid checks.
Yoho.cloud shall not be liable for taxes of any nature associated with purchases from Customer or Yoho.cloud's servers. Customer shall comply with full responsibility for all costs and taxes related to Customer's website.
Backups are the sole responsibility of the Customer. Our backup service may be supplied as a courtesy. Yoho.cloud will not be accountable for any loss, erasure, or corruption of Customer's data or files.
We perform weekly and monthly backups of server configurations and customer data. Backups are maintained for one week and one month respectively. The backup service is applicable to shared, reseller, email, and database hosting packages. In the event of data loss due to Customer fault, a technical support charge may apply to recover data from our backups.
Yoho.cloud limits its damages to the Customer for any downtime to the pro-rated hosting fee during the period of unavailability. Yoho.cloud denies any additional liabilities for damages arising from service non-availability.
Yoho.cloud retains control of any and all IP addresses assigned to the Customer and reserves the right to change any IP addresses at its sole discretion.
All services supplied by Yoho.cloud must be used for lawful purposes only. The laws of the EU and the United States of America apply. The Customer must indemnify and hold harmless Yoho.cloud from any claims arising from use of our services.
Using a shared account as a backup/storage device is not permitted, except for one cPanel or Plesk backup of the same account. Please do not take backups of your backups.
Without prior approval and written permission, you may not create frames around our webpages that alter in any way the visual presentation or appearance of our website.
Customer agrees to defend, indemnify, save and hold harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney's fees, against Yoho.cloud, its agents, customers, servants, officers, and employees. Customer agrees that use of Yoho.cloud's servers is at Customer's sole risk.
Neither Yoho.cloud, its employees, agents, or resellers will be liable for any claims of actual, compensatory, or consequential damages including losses due to loss of data, delays, non-deliveries, or service interruptions. Customer's exclusive remedies shall not exceed the aggregate amount paid during the term of this Agreement.
Due to the public nature of the Internet, Yoho.cloud is not responsible for privacy of email or other data transferred via the Internet or other networks.
Scripts must use low system resources. Scripts consuming excessive RAM or processor may be subject to immediate suspension until an alternative solution is reached.
Each account shall not use more than 20% of system resources at any given time. Accounts continuously exceeding this limit may be warned and subsequently suspended.
Scripts must not interact with any server configuration or hardware. Accounts running such scripts are subject to immediate termination without refund.
Scripts cannot be used or referenced from any other website not hosted by Yoho.cloud. Scripts must execute in a timely fashion. Any script designed to attack or maliciously affect the server is absolutely prohibited and may be reported to the proper authorities.
Perl, PHP, Python, or any script-based chat room scripts are strictly prohibited. High-bandwidth scripts (chat rooms, banner rotation) may only run on high-end accounts. Scripts must be kept secure — unnecessary chmoding to 777 is a violation of this policy.
This Agreement can be terminated by either Customer or Yoho.cloud at any time without prior notice and without cause. However, Yoho.cloud will try to provide adequate advance notice whenever possible.
Unused service may be prorated and refunded on request only if: (a) the Customer has made at least two hosting payments, and (b) there are at least 15 days remaining in the current billing period. If these conditions are not met, services are terminated at the end of the current billing period with no refund issued.
Shared web hosting accounts must not be used for distributing software, multimedia products, illegal gambling scripts, or illegal audio/video files. Websites where multimedia storage exceeds 70% of total disk usage may be considered as abusing resources.
Yoho.cloud makes no endorsement, claims, or guarantees concerning the services provided by our clients and will not be held accountable for any disputes or claims against said clients. In no event shall Yoho.cloud be accountable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from the use or performance of this website or from any information, services, or products supplied.
We reserve the right to refuse, cancel, or suspend service at our sole discretion. This applies to issues including spam, script abuse, or when a customer becomes unreasonable, unprofessional, or threatening. A backup of the account(s) will be provided.
Use of profanity or abuse towards any Yoho.cloud employee via chat, email, phone, support ticket system, or in any other form will result in a complete block from our support system and may subject the client to account cancellation without a refund.
This agreement shall be governed by and construed in accordance with the laws of EU, US, or Nepal. Yoho.cloud reserves the right to change these Terms of Service at any time. Changes shall become effective within thirty (30) days of publication of the revised version on www.yoho.cloud. Your continued use of your subscription after expiry of the 30-day period shall constitute your acceptance of the revised terms.
